...in the case of products covered by a harmonized performance standard, the European Commission can establish product requirements through delegated acts?

With the entry into force of the new Regulation (EU) 2024/3110, the European Commission now has the possibility to adopt delegated acts to establish specific requirements for certain families or categories of products. This means that even when a product is already covered by a harmonized performance standard, new requirements may be introduced relating, for example, to environmental, functional, and safety aspects.

In such cases, before being placed on the market, construction products must comply with the pre-established product requirements. Where a given construction product is subject to requirements, the declaration of performance and conformity indicates that compliance with those requirements has been verified. By issuing the declaration of performance and conformity, the manufacturer assumes responsibility for the conformity of the product with its declared performance and with any requirements applicable to the products and becomes liable under Union and national law on contractual and non-contractual liability.
